In her article for Bay Area Parent, associate Maya Younes offers some guidance for parents who may need a modification to their child support order because of COVID-19 financial hardships. She says that courts generally do not modify child support “unless there has been a material change of circumstances,” but a decrease in income may justify a change to the order.
Maya encourages parents to assess their options and not delay their request for a modification, since it could be weeks or months before a hearing date. Ultimately, she says, “Whether circumstances have sufficiently changed to warrant a modification is determined case by case.”
