The article details the DOJ’s appeal of the Ninth Circuit’s en banc decision from January, which paved the way for McManis to receive attorney’s fees for its defense of Dr. Ibrahim. In its petition, the DOJ alleged that the Ninth Circuit overstepped its bounds in its en banc ruling and that the justices should take up the case.
