In an interview with the Daily Journal, Partner James McManis commented on whether municipalities and counties have any recourse against the State of California for withholding federal disaster relief funding. The issue stems from rural counties reopening their economies despite Gov. Newsom’s statewide COVID-19 shutdown orders.
Jim doubts that judges will be sympathetic to counties which lose federal money. He says, “I suppose counties and cities might argue Gov. Newsom may not withhold the money but this is a very different situation from challenges against the federal government over sanctuary states because here we are dealing with a public emergency.”
