Partner Michael Warren spoke with ABC 7 Bay Area for a video segment regarding employers conducting temperature checks on their workers when they re-open following the COVID-19 pandemic. The segment aired on ABC 7 on April 17.
The issue of employee temperature checks has been a “hot one” in the conversation over how employers may protect their workers during the pandemic. The EEOC has issued guidance explaining that temperature checks are allowed, but Michael warns that a person denied access to work because of a high temperature may argue a case of discrimination. He says, “It is important a temperature screen should be done in an unbiased, nondiscriminatory, neutral manner.”
