James McManis Addresses Santa Clara Refusing to Disclose Details on Probe

Partner James McManis recently spoke with San Jose Spotlight regarding the City of Santa Clara refusing to divulge critical information in its investigation into the city attorney’s alleged misconduct. The city refuses to say how much the probe will cost, when it will be done or whether it will be public. The city has rejected numerous public records requests.

Jim comments on the city’s practice, saying “The whole thing with the Public Records Act—the cities, the counties, all government entities—they hate it. They like to operate in secrecy. And they don’t like having to disclose anything.” Jim also explained that the fee agreement between Santa Clara and the outside law firm is privileged and protected, but other aspects – like the status, cost and publicity of the investigation can be disclosed.
