Our client, an African immigrant, was driving her children home from day care on a dark stretch of road in rural Santa Clara County. When she looked in the rearview mirror, she saw flashing lights behind her. Fearing for herself and her children’s safety, she pulled over at the nearest well-lit shopping center. The police traumatized her and her children by ordering our client out of her car at gunpoint. She was charged with evading police and a moving violation for failing to change lanes when passing a parked police vehicle with flashing lights. McManis Faulkner thoroughly examined the case and persuaded the District Attorney to dismiss all charges.
