McManis Faulkner successfully defended a lawyer in a civil lawsuit in which plaintiff was seeking millions of dollars in damages for alleged fraud, professional negligence, and breach of fiduciary duty.
The case arose in connection with a lease which was drafted back in the mid-2010s and eventually executed in July of 2017. Plaintiff claimed that the client was his attorney during the time the lease was negotiated and drafted, but that he helped to prepare a lease that benefitted another party rather than plaintiff. Our client was a long-time employee of the other party, and had never been employed by, or served as counsel for, plaintiff at any point.
After several weeks of trial and several days of deliberations, the jury returned a verdict in our client’s favor, agreeing that each and every cause of action alleged against him by plaintiff was barred by the applicable statutes of limitations.
